election of 2008 was the election where Americans went to the polls to
supposedly vote for a natural-born citizen, but a sample of the candidates
reveals anything but, three candidates either had constitutionally

When we heard that John McCain was pronounced a natural-born citizen by Senate Proclamation 511 on April 10, 2008, because he was born of two American Citizen Parents on a military base under the American flag, in the Panama Canal Zone, which was under the jurisdiction of the United States we felt comfortable that he was for all intent and purposes of our Founding Fathers a natural-born citizen. What is more with this resolution we thought the Senate had done its 20th Amendment duties.
Around late July and early August 2008 rumors stated to come out about Barack Hussein Obama, II’s lack of natural-born status. The release of his questionable Certificate of Live Birth didn’t put our worries to rest. Even before this time McCain was starting to be challenged in court, by Fred Hollander. Even though many of us supported John as a patriot and believed he was a natural-born citizen, we seen that Obama’s supporters were challenging McCain and while we doubted they would win, we figured that with them investigating McCain we could investigate Obama and together we would make sure that a natural-born citizen would be elected to the Office of the President as the Founding Fathers wanted.
We heard that Hollander had acquired and released McCain’s birth certificate to the court and the court had dismissed the case. Slowly some facts coming from the this case started coming to light around October. Some of these facts while not easily provable were starting to be disturbing.
What was even more disturbing was John McCain’s silence on the questions surrounding Barrack Obama’s eligibility questions. Two things just did not make sense, first looking at McCain as a patriot we had to wonder why he would allow someone even try to enter the oval office if they were not qualified, and from a purely human nature perspective since his qualifications were challenged and his birth certificate released and made public by the plaintiff Hollander would he also demand Barrack Obama do the same. McCain’s silence in this matter started to make us think, ……….

At this time Phil Berg who filed the initial lawsuit against Obama was denied on a technicality, and election time was fast approaching. With the last weeks approaching some of us had concerns about McCain’s eligibility, but we were seriously worried about Obama’s eligibility.
After reading and researching
the outstanding work of Professor Gabriel J. Chin, in his work “11 months and a hundred
yards short of citizenship,” we began to understand what was caught
in John’s throat. Reviewing the facts Professor Chin presents it is clear
that John McCain was not born under the American flag on a military base in the

When we add up both Jay and Hamilton we arrive at only one definition for a natural born citizen that satisfies their concerns, and that is Vattel’s definition in Book One, Chapter 19,
§ 212. Of the citizens and natives.
“The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country.”
Does this mean that John McCain is not a natural born citizen, if we accept the fact that the Supreme Court of the United States codified Vattel in our Federal Common Law, then the answer is no.

Since John McCain was born of two American citizen parents, and who by definition of the Law of Nations that the Supreme Court of the United States says is the foundation of our Federal Common Law, they did not quit the country, John McCain’s birth would meet the definition of Vattel’s definition found in § 212. Of the citizens and natives. What is more since McCain was born without Panamanian citizenship he satisfies the concerns of the founding fathers, both John Jay and Alexander Hamilton.
If John McCain had competent
legal council instead of political legal council and allowed this to go to the
Supreme Court there is without a doubt that he would have been found to be a
natural born citizen as required under Article II, Section 1 of the
